| Probable cause affidavit: | SUBMITTED BY: CRUZ, ABNER 0517 (AR10115446) UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT in excess of twenty GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(C) ON 061910 WHILE TRAVELING ON US HIGHWAY 19 AT THE INTERSECTION OF STATE ROAD 44, DETECTIVE MARSHALL AND I OBSERVED A SILVER SATURN VEHICLE WITH AN INOPERABLE RIGHT BRAKE LIGHT. DETECTIVE MARSHALL RAN THE TAG ON THE VEHICLE WHICH CAME BACK REGISTERED TO AN ABEL SALAZAR GUERRA. also, detective marshall was advised that mr guerra was On FELONY PROBATION/SUPERVISED RELEASE STATUS, for TRAFFICKING IN cocaine and had a curfew of 2200 hours which he was clearly in violation of. his photograph was obtained through the d.a.v.i.d. system, at which time we pulled next to the driver side of the vehicle and observed that the photograph matched the driver of the vehicle. DETECTIVE MARSHALL AND I then initiated a traffic stop by activating THE emergency lights IN MY PATROL VEHICLE at the intersection us highway 19 and west fort island trail in crystal river. i approached the driver side of the vehicle, made contact with the subject and requested his driver's license, the vehicle registration and proof of insurance. the driver/DEFENDANT, MR ABEL SALAZAR GUERRA, provided the requested documents. i returned to my patrol vehicle to verify the information giveN. his information matched the information i had received earlier through ncic/fcic, at which time as i was returning to MY PATROL vehicle, canine deputy tackett and deputy bergen arrived on scene. canine deputy tackett and canine priest conducted an exterior sniff of the vehicle. canine deputy tackett advised that canine priest had alerted to the odor of narcotics coming from the DEFENDANT'S vehicle. i asked the defendant to exit the vehicle. detective marshall remained with the defendant while deputy bergen and i conducted a search of the vehicle. while searching the vehicle, deputy bergen discovered a bag on the passenger side of the vehicle. upon looking inside OF THE BAG, deputy bergen discovered a clear plastic bag containing a green leafy substance which he identified as cannabis through his training and experience. deputy bergen retrieved both bags from the vehicle and asked the defendant if the bags belonged to him, to which The DEFENDANT stated yes. at that time, the defendant was placed under arrest for possession of cannabis in an amount in excess of twenty grams. he was handcuffed (double locked) behind his back and secured in the rear seat of my patrol vehicle FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. a continued search of the vehicle did not yield any further contraband. the green leafy substance was field tested, which yielded a positive result for the presence of cannabis. the cannabis was weighed and weighed 27.5 grams. the cannabis was packaged and later turned in to the citrus county sheriff's office evidence locker. PRIOR TO LEAVING THE SCENE, the defendant's vehicle was impounded and towed to the citrus county sheriff's office impound yard for possible forfeiture. detective marshall completed the forfeiture paperwork. upon arrival at the detention facility, the defendant was processed, BOOKED and held on a bond of $5,000.00, in accordance with the bond schedule. *NOT-EXEMPT* |
