| Probable cause affidavit: | SUBMITTED BY: BAIRD, MATTHEW 0624 (10114018AR) (0351) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked AS A HABITUAL TRAFFIC OFFENDER, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(5) ON 032710 AT APPROXIMATELY 1640 HOURS, I WAS CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF WEST MAIN STREET AND NORTH FLORIDA AVENUE, AT WHICH TIME I OBSERVED THE DEFENDANT ENTER THE DRIVER'S SIDE DOOR OF A VEHICLE THAT WAS PARKED AT JOES FAMILY RESTAURANT. I DID OBSERVE THE DEFENDANT WAS THE SOLE OCCUPANT OF SAID VEHICLE AS HE EXITED THE PARKING LOT AND BEGAN TO TRAVEL EASTBOUND ON WEST MAIN STREET. IT WAS KNOWN TO THIS DEPUTY THAT THE DEFENDANT'S DRIVER'S LICENSE WAS REVOKED AND THAT HE WAS CLASSIFIED AS A HABITUAL TRAFFIC OFFENDER. AT THAT TIME I INITIATED A TRAFFIC STOP AT 805 WEST MAIN STREET AND MADE CONTACT with THE DEFENDANT. THE DEFENDANT DID PROVIDE A FLORIDA IDENTIFICATION CARD AND DID ADVISE HIS DRIVER'S LICENSE WAS SUSPENDED. THE DEFENDANT'S INFORMATION WAS ENTERED IN FCIC/NCIC AND "DAVId" and was verified that his DRIVER'S LICENSE had been suspended on 061405 for a period of five years. "david" also advised that the DEFENDANT's habitual traffic offender status was projected to expire on 061310. at this time the DEFENDANT was placed under arrest, HANDCUFFED (DOUBLE LOCKED) IN BACK, and placed in the rear of my patrol VEHICLE. at this time DEPUTY behnEn arrived on scene. see k9 supplement. the DEFENDANT'S VEHICLE was released to an ACQUAINTANCE on scene. the DEFENDANT was transported to the CITRUS COUNTY DETENTION FACILITY where the bond was set at $2,000.00 per the bond schedule. the DEFENDANT was issued a FLORIDA UNIFORM TRAFFIC CITATION number 1565esh1, for driving while DRIVER'S LICENSE suspended or revoked, with an in custody court date of 041910 at 0830 hours AT the CITRUS COUNTY court house. *NOT-EXEMPT* |
