| Probable cause affidavit: | SUBMITTED BY: BYRD, JEDIDIAH 0737 (AR15-16045)(15-106323) DID DRIVE A MOTOR VEHICLE UPON A HIGHWAY IN THE STATE OF FLORIDA WITHOUT HAVING A VALID DRIVER'S LICENSE AUTHORIZING HIM TO DO SO, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 322.03(1). ON 081415, I WAS DRIVING SOUTHBOUND ON NORTH INDEPENDENCE HIGHWAY, WHEN I OBSERVED A GREEN VAN DRIVING NORTHBOUND ON NORTH INDEPENDENCE HIGHWAY, WHICH HAD AN INOPERABLE PASSENGER HEADLIGHT. AT THAT TIME I MADE A U-TURN AND CAME UP BEHIND THE VEHICLE, BEARING FLORIDA LICENSE PLATE H313MJ. I ACTIVATED MY EMERGENCY LIGHTS AND I CONDUCTED A TRAFFIC STOP AT EAST SUNUP COURT AND NORTH INDEPENDENCE HIGHWAY. I APPROACHED THE VEHICLE AND MADE CONTACT WITH THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR BARRY LANE. I ASKED THE DEFENDANT FOR HIS DRIVER'S LICENSE, REGISTRATION, AND PROOF OF INSURANCE. AT THAT TIME THE DEFENDANT ADVISED ME THAT HE DID NOT HAVE A DRIVER'S LICENSE IN THIS STATE OR ANY OTHER STATE, AND HAS NEVER HAD ONE. HE HAD THREE PRIOR CONVICTIONS OF OPERATING A MOTOR VEHICLE WITHOUT A DRIVER'S LICENSE. UPON RUNNING HIS INFORMATION THROUGH TELETYPE, IT WAS CONFIRMED THE DEFENDANT DID NOT HAVE A VALID DRIVER'S LICENSE. HE ALSO HAD MULTIPLE SUSPENSIONS FOR FINANCIAL OBLIGATIONS. THE DEFENDANT RECEIVED NOTICE BY A COURT ORDER. I ADVISED THE DEFENDANT HE WAS BEING PLACED UNDER ARREST. I HANDCUFFED HIM (DOUBLE LOCKED) BEHIND HIS BACK. I SEARCHED HIM AND PLACED HIM IN THE REAR SEAT FO MY PATROL VEHICLE. I TRANSPORTED HIM TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS TURNED OVER TO THEIR STAFF. THERE WERE THREE OTHER INDIVIDUALS IN THE VEHICLE, WHICH OF THEM HAD A DRIVER'S LICENSE. THEY CALLED SOMEONE TO COME AND PICK THEM AND THE VEHICLE UP. A UNIFORM TRAFFIC CITATION WAS ISSUED TO THE DEFENDANT AND A COPY WAS TURNED IN TO THE CITRUS COUNTY DETENTION FACILITY, UNIFORM TRAFFIC CITATION NUMBER, A1BU8VP, WITH A COURT DATE OF THURSDAY, 090315, AT 1300 HOURS. HE WAS ALSO ISSUED A WARNING FOR AN INOPERABLE HEADLIGHT. BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. |
