| Probable cause affidavit: | Unlawfully enter or remain in a certain structure, or the cartilage thereof, with the intent to commit another offense, namely theft, therein; and Did unlawfully obtain the property of another, namely Habitat for Humanity, with the intent to deprive the other of said property; to wit On 08/17/15, the complainant reported to the Sheriffâs Office that unknown person(s) went to the area of the storage trailer and stole items, specifically clothing from the trailer. They provided security video which showed two incidents. One was in the evening hours of 08/15/15 and the second was during the night hours of 08/16/15. During the first event, the defendant along with several others entered the cartilage of the rear of the facility. The defendant is seen on the security video trying to open a storage container and later lifts a piece of plastic sheeting that is on a forklift and removing a large cargo strap. The defendant then walks out of view of the camera while carrying the strap. During the second event a male and female are seen going to the rear of a trailer (that is pulled by a semi) that is used for storage. The door of the trailer is out of view of the camera. The defendant is seen walking to the door area, then walking away with sacks of clothing that is stored in the trailer. The defendant was identified by a neighbor who stated the defendant had parked in her yard and who told her that he had been carrying things. On 08/28/15, I made contact with the defendant at his residence. He was asked to step outside and speak with me. He stepped onto the front porch. I explained why I was there. He stated he had taken some couches that had been left in the rain. I asked about the clothes and he became evasive. I asked about who was with him and he stated he would not speak about other people. He was arrested and transported to the county jail. I obtained a statement from a witness who stated she observed the defendant take bags of shoes from the facility but could not specify the exact place from which the shoes were stored. Upon arrival at the jail, he declined to give a formal statement. He was charged with one count of burglary and petit theft and held in lieu of $5,250 bond. |
