Probable cause affidavit: submitted by: strickland, jason 0583 (ar12-338) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: beall’s department store, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN five thousand dollar ($5000.00), TO WIT: actual value of the property being $751.98, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. (and) DID UNLAWFULLY AND KNOWINGLY, while committing or after committing theft of property, resist the reasonable effort of a merchant OR merchant’s employee, to recover the property WHICH THE merchant OR merchant’s employee had probable cause to believe the individual had concealed or removed from its place of display or elsewhere, IN VIOLATION OF FLORIDA STATE STATUTE 812.015(6). (and) THE DEFENDANT ms candace l bautista, WAS PLACED ON felony PROBATION FOR possession of cocaine. HER PROBATION COMMENCED ON 072711. THE DEFENDANT DID VIOLATE THE TERMS OF HER PROBATION IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 948.06, TO WIT: the defendant HAD NEW law violation, to wit: grand theft and resisting a merchant. ON 031612, AT APPROXIMATELY 1203 HOURS, I RESPONDED TO 2851 EAST GULF TO LAKE HIGHWAY IN INVERNESS WHICH IS ALSO KNOWN AS THE BEALL’S DEPARTMENT STORE, IN REFERENCE TO A SHOPLIFTER IN CUSTODY. UPON MY ARRIVAL I MADE cONTACT WITH THE LOSS PREVENTION OFFICER, IN HIS OFFICE. LOSS PREVENTION OFFICER WHITLER ADVISED THAT AT APPROXIMATELY 1135 HOURS, HE BEGAN MONITORING THE DEFENDaNT ON HIS VIDEO CAMERA SYSTEM, WHERE HE OBSERVED THE DEFENDANT, MS CANDaCE BAUTISTA BEGIN to SELECT MULTIPLE PIECES OF CLOTHING, WHERE SHE THEN BEGAN REMOVING THE HANGERS AND PLACING THE CLOTHING IN A SHOPPING CART. THE DEFENDANT THEN SELECTED A BEACH BAG AND WENT TO THE HOMES DEPARTMENT AND THAT WAS WHERE HE OBSERVED HER PLACING ALL THE CLOTHING INSIDE THE BEACH TOTE. MR WHITLER ADVISED HE THEN OBSERVED THE DEFENDANT PROCEED TO THE FRONT DOOR OF THE STORE WHERE SHE PASSED ALL POINTS OF PURCHASE AND EXITED THE FRONT DOOR. AT THAT TIME HE MADE CONTACT WITH THE DEFENDANT AND IDENTIFIED HIMSELF. AT THAT TIME THE DEFENDANT BEGAN RESISTING HIM AND TOOK OFF RUNNING TOWARD THE PARKING LOT. MR WHITLER THEN PURSUED HER AND ONCE HE HAD GRABBED HER TO RESTRAIN HER, THE DEFENDANT BEGAN FLAiling HER ARMS IN AN ATTEMPT TO bREAK LOOSE OF HIS HOLD. mr WHITLER AdVISED HE PLACED HER ON THE GROUND AND SECURED HER IN HANDCUFFS (DOUBLE LOCKED) BEHIND HER BACK. THE DEFENDANT WAS THEN ESCORTED TO THE LOSS PREVENTION OFFICE AND THIS AGENCY WAS NOTIFIED OF THE INCIDENT. WHILE SPEAKING with MR WHITLER HE ADVISED THAT THE DEFENDANT HAD ATTEMPTED TO STEAL $751.98 WORTH OF MERCHANDISE. HE ALSO ADVISED ME THAT HE WISHED THE DEFENDANT TO BE TRESPASSED FROM THIS LOCATION, WHICH WAS DONE. MR WHITLER ALSO PROVIDED ME WITH A WRITTEN SWORN STATEMENT, WHICH HE COMPLETED AND WAS SWORN TO. I WAS ALSO PROVIDED WITH A SALES RECEIPT OF ALL THE MERCHANDISE TAKEN BY THE DEFENDANT. AT THIS TIME I VIEWED THE VIDE O SURVEILLANCE FOOTAGE WHICH corroborateD mr whitler’s statements. i was also able to observe the defendant resist mr whitler. at this time the defendant was advised she was being placed under arrest for one count of retail grand theft and one count of resisting a merchant. i placed handcuffs on the defendant and double locked THEM AND took off mr whitler’s handcuffs, which were returned to him. the defendant was transported to the citrus county detention facility for further processing. upon arrival the defendant was turned over to detention facility staff and a criminal history was run on the defendant at the same time. it revealed she was possibly on probation in citrus county. at that time i made contact with probation officer inman who advised that the defendant was actually on probation and he asked me to go ahead and violate her probation. at that time the defendant was also charged with one count of violation of probation. the defendant’s bond was placed at $2000.00 per the bond schedule for retail grand theft. $500.00 bond for resisting a merchant, and no bond per the violation of probation. the defendant’s total bond was set at no bond due to the vop warrant.
