| Probable cause affidavit: | SUBMITTED BY: RAMOS, ROBALDO 0515 (AR11118685) DID KNOWINGLY ATTACH TO ANY MOTOR VEHICLE OR MOBILE HOME ANY REGISTRATION LICENSE PLATE, OR WHO KNOWINGLY ATTACHES ANY VALIDATION STICKER OR MOBILE HOME STICKER TO A REGISTRATION LICENSE PLATE, WHICH PLATE OR STICKER WAS NOT ISSUED AND ASSIGNED OR LAWFULLY TRANSFERRED TO SUCH VEHICLE, IS IN VIOLATION OF FLORIDA STATE STATUTE 320.26. While responding to a dispatched call, I was stopped at a red light located at NORTH Montgomery Avenue and West Main Street, at which time, I noticeD a brown Honda in front of me with an unreadable decal. I entered the tag into the NCIC/FCIC database AND it revealed the tag attached belonged to a 1993, Ford, pickup. As the vehicle made a right turn on to West Main Street heading west bound and then into the parking lot of Sweet Bay located at 1202 West Main Street. Once in the parking lot I activated my emergency lights and conducted a traffic stop. The driver pulled into a parking space. As I approached the driver, who was later identified as the DEFENDANT, MR Derek Wallen, I askED him for his driver license, proof of insurance and proof of registration. Mr Wallen replied, "I have a driver license but no insurance." I asked how about the registration, and he stated, "No, but I do have the title to the car". I asked does the tag belong to your car. Mr Wallen stated, "No I put it on, I was told that I can do that for TWO weeks before I have to get it registered". At which time, I advised him by doing that, it is a criminal offense and HE could be arrested. I then went back to my patrol VEHICLE and checkED to see if the vehicle was stolen and to make sure that Mr. Wallen had a valid driver'S license. After everything came back clear, I walked back to Mr. Wallen and requested him to step out of his vehicle. once outside the vehicle he was subsequently arrested for attachED the tag NOT ASSIGNED to his vehicle. Mr Wallen's vehicle was secured and left in the parking lot of Sweet Bay. Mr. Wallen was handcuffed (double locked) and transported to Citrus County Detention Facility for booking and processing. Mr. Wallen'S bond was set at $250.00 per bond schedule. A copy of the property receipt for the tag was given to Mr Wallen. Mr. Wallen was issued the following Uniform Traffic Citations: 3911-GJX (1) No motor vehicle registration, 3912-GJX (2) AttachED tag not assigned With a MANDATORY court date OF 012011 at 1300 HOURS AND 3913-GJX (3) No proof of insurance Payable amount of $116.00. *NOT-EXEMPT* |
