| Commentaries: | Comments According to Official documents, Duncan was found guilty by jury trial on June 4, 2004 in Snohomish County Superior Court of Rape in the 2nd degree. He was given a minimum term of 96 months in prison with a maximum term of life. Duncan was also tried on three counts of Indecent Liberties and one count of Assault 2nd Degree while armed with a deadly weapon. He was found not guilty of these charges in Superior Court. The victim in the Rape conviction was an adult female who was a patient of Duncan's as he was the victim's Chiropractor. Duncan sexually assaulted this victim while doing a Hip Adjustment . The Snohomish Police Department during their investigation had nine (9) additional victim's come forward to report being a victim of Duncan's dating back to 1980 while he practiced as a Chiropractor. Duncan talked both to his Community Corrections Officer and a Detective with the Sheriff's Office prior to his release from prison. During this meeting Duncan admits to his one victim only and does not accept the fact that victims that were not charged due to the statute of limitations expiring are also victims. Duncan has a known history of offending against females from 1980 until 2002. All victim were females between the age of 14 and 49.Duncan attended Sex Offender Treatment while in prison. Duncan will be on active supervision for life with the Department of Corrections. He is being supervised by the Monroe Office. 360-794-2592. Duncan will release on March 10, 2011 Shall enter and complete Phase III (Community Phase) of the Sex Offender Treatment Program in the community, which means making progress in treatment and will follow all conditions outlined in his treatment contract. Shall have no direct or indirect contact with victim, including any individuals named as victims in Counts 2-5 of Snohomish County Cause # 02-1-02257-4 or any unadjudicated victim of which he is aware of. Shall not engage in a romantic relationship without first disclosing his status as a sex offender and disclose the nature of his crime uncluding his unadjudicated victims.. Shall not enter or remain in Internet or telephone chat rooms or participate in social networking or dating websites. Shall not hold any position of trust or authority over women nor provide any services or counseling to women on an individual basis. Shall not leave the State of Washington without permission of his Community Corrections Officer and ISRB. Shall not possess, purchase, peruse or view any pornographic materials including works of art not considered sexually explicit materials . Sexually explicit materials are any pictorial representations that are intended for sexual gratification . Shall not purchase, own, have in his possession, receiving, shipping or transporting a firearm, deadly weapon, ammunition or explosives or under his control any firearm or deadly weapon. Shall not purchase, possess or consume any alcohol, beverage or medicinal. Shall not purchase, possess or consume any mind or mood altering substances, drugs, narcotics, controlled substances or drug paraphernalia without a valid prescription from a licensed physician. Shall not travel West of Highway 9 Between Getchell Hil (84th Street NE)l to the North and 128th to the South without prior written approval of his Community Corrections Officer. Shall not work as a chiropractor or for anyone in a chiropractic or similar practice. Shall stay out of establishments. such as bars, taverns, casinos and cocktail lounges where alcohol is a primary beverage served. Shall submit to Polygraph examination at the discretion of his Community Corrections Officer. Shall submit to periodic and random drug and alcohol testing. |
