| Probable cause affidavit: | SUBMITTED BY: NEAL, GARRETT 0676 (AR10117695) did commit certain acts which are of such a nature as to corrupt the public morals or outrage the sense of public decency or affect the peace and quiet of a person who may witness them, or did engage in brawling or fighting, or in such conduct as to constitute a breach of the peace or disorderly conduct TO WIT: THE DEFENDANT CONTINUALLY USED RACIAL SLURS WHILE CITIZENS AND CHILDREN WERE PRESENT, in violation of Florida Statute 877.03; ON 103110 I WAS DISPATCHED 9513 NORTH ARGO WAY IN CITRUS SPRINGS IN REFERENCE TO A DISTURBANCE IN PROGRESS. UPON ARRIVAL, I MADE CONTACT WITH THE RESIDENT AT THAT ADDRESS WHO ADVISED THAT SHE AND THE DEFENDANT, MS HEATHER CATHERINE SANDIFORD, HAD GOTTEN INTO AN ALTERCATION. I WAS ATTEMPTING TO GATHER ALL INFORMATION FROM THAT RESIDENT AND THE DEFENDANT, WHEN THE DEFENDANT CALLED ONE OF THE DEPUTIES ON SCENE A "NIGER". THE DEFENDANT WAS TOLD BY MYSELF AND OTHER DEPUTIES NOT TO SPEAK LIKE THAT because OF THE AMOUNT OF CITIZENS AND CHILDREN IN THE AREA THAT WERE TRICK OR TREATING. THE DEFENDANT DISOBEYED SEVERAL MORE VERBAL COMMANDS FROM MYSELF AND OTHER DEPUTIES ON SCENE AND THE DEFENDANT CONTINUED TO BE VOCAL TOWARDS THE RESIDENTS AT THE INCIDENT LOCATION. THE DEFENDANT THEN ASKED ALOUD "WHAT DO ALL NIGERS HAVE IN COMMON?". AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST FOR BREACH OF PEACE, HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT 'S BOND WAS SET AT $250.00 PER THE BOND SCHEDULE.
