| Probable cause affidavit: | Utter and publish as true a false, forged or altered record, deed, instrument or other writing mentioned in Florida Statute 831.01 knowing the same to be false, altered, forged or counterfeited, with the intent to injure or defraud any person; to wit: On 01/25/13, the defendant took possession of a co-workerâs paycheck, written for $550.00 and, without the co-workerâs consent, cashed the paycheck at the Citgo station, located at CR 491 and US 41. On 02/21/13, a sworn written statement was obtained from the other co-worker, who stated that he did not give the defendant consent to cash his paycheck. He did acknowledge that he owed the defendant some money but was adamant he did not give the defendant permission to cash his check. On 02/21/13, a sworn written statement was obtained from the Citgo clerk, who stated that the defendant came in to cash his paycheck, as is customary for the defendant. After the transaction was complete, he learned the check belonged to another person. On 02/26/13, the clerk identified the defendant from a photographic line-up. On 03/28/13, contact was made with the defendant at the Citrus County Jail, where he was being held on unrelated charges. He was read Miranda from an agency issued card by Det Craig Fass. He admitted to cashing the check but stated he had permission from the co-worker to do so. He stated the co-worker owed him money and he cashed the check and the next day gave the co-worker $200.00 from the $550.00 check. The defendant was arrested and charged with one count of uttering a forged instrument, bond set at $2000. |
