SUBMITTED BY: CANFIELD, LAIRD 0544 (AR0810176 2) DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY L CANFIELD, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: CONDUCT A TRAFFIC STOP, BY PROVIDING FALSE NAMES TO THIS DEPUTY, IN VIOLATION OF FLORIDA STATE STATUTE 843.03 AND DID KNOWINGLY, WHILE HIS OPERATOR'S OR CHAUFFEUR'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE UPON THE HIGHWAYS OF THIS STATE, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). On 021708 at 0101 hOUrs, I was driving northbound on US HIGHWAY 19, approaching STATE ROAD 44 when I observed a red four door sedan come onto northbound US HIGHWAY 19 from STATE ROAD 44. After the vehicle was on US HIGHWAY 19, I observed the vehicle appear to be exceeding the posted speed limit of 40 MILES PER HOUR (mph.) I attempted to catch the vehicle to pace-clock the vehicle's speed. As I acCelerated to catch the vehicle, the vehicle appeared to be speeding up. As I passed NORTHWEST Snug Harbor, my PATROL vehicle'S speedometer displayed 70 mph and was still climbing as the red vehicle was still accelerating away from me. I activated my in- car video system and emergency warning lights to conduct a traffic stop. The vehicle slowed and turned onto NORTHWEST 6th AveNUE, at which time I activated my patrol vehicle siren. The red vehicle continued east on NORTHWEST 6th AveNUE, still not stopping. The red vehicle turned north into the Crystal River Mall still not stopping. The red vehicle manEuvEred through the mall PARKING LOT and finally stopped near the South ENTRANCE TO THE Sears STORE, at which time the driver's door opened slightly. I exited my patrol vehicle and made contact with the driver/ defendant who identified himself as MR Jimmy Richard Devavedh, with a date of birth of 091577. I asked the defendant why he did nOt stop and he claimed he did nOt see or hear me. I requested the defendant exit the vehicle, aT WHICH TIME A pat-down SEARCH WAS CONDUCTED. During the pat-down SEARCH, I felt a hard plastic card about the size of a driver's license in the defendants rear pocket. I asked the defendant what this was, TO WHICH he stated it was his brother's identification card. The identification card was retriEved and was found to belong to MR Jimmy Lee Parker with a date of birth of 123081. A D.A.V.I.D. check of MR JimmY R Devavedh revealed no record found. I again asked the driver/DEFENDANT FOR his name and he provided me with THE NAME Jimmy R Denanhan with the same date of birth. A D.A.V.I.D. check of this name revealed no record found. The defendant was handcuffed, detained and placed in the rear seat of my patrol vehicle. The defendant then provided another name of MR Jimmie R Devaughin with the same date of birth. A D.A.V.I.D. check revealed no record found. CORPORAL BOnura stated he knew Jimmy Vaughn and stated the subject I had detained was not Jimmy Vaughn. The DEFENDANT finally stated his name was Jimmy Lee Parker. The DEFENDANT was transported TO the CITRUS COUNTY DETENTION FACILITY where he was booked and processed for Obstruction by disguised person, IN VIOLATION OF FLORIDA STATE STATUTE 843.03. HE WAS ALSO CHARGED WITH Driving While License Suspended/REVOKED, WITH KnowlEDGE, IN VIOLATION OF FLORIDA STATE STATURE 322.34(2) AND ISSUED FLORIDA UNIFORM TRAFFIC CITATION number 8501-FIQ. The defendant was also issued UNIFORM TRAFFIC citation number 8125-FGW, for violation of a traffic control device, UNLAWFUL SPEED (70 MPH IN A POSTED 45 MPH SPEED ZONE,) IN VIOLATION OF FLORIDA STATE STATUTE 316.074(1). The defendant's TOTAL bond was set at $1,000.00, per the bond schedule. Prior to leaving the scene, the DEFENDANT'S vehICLE was released to the registered owner. *NOT-EXEMPT* |
