| Probable cause affidavit: | SUBMITTED BY: seffern, jonathan 0623 (ar10115110) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 053110, WHILE CONDUCTING EXTRA TRAFFIC CONTROL ON SOUTH SUNCOAST BOULEVARD, IN HOMOSASSA, I OBSERVED A RED IN COLOR PICKUP TRUCK MAKING A RIGHT HAND TURN OFF OF WEST WHITE DOGWOOD DRIVE ON TO SOUTH SUNCOAST BOULEVARD. AS THE RED PICKUP TRUCK MADE THE RIGHT HAND TURN and PRECEDED SOUTH ON SOUTH SUNCOAST BOULEVARD, I NOTICED THE DRIVER'S SIDE WINDOW TO BE OPEN and I OBSERVED A WHITE MALE subject LATER IDENTIFIed AS THE DEFENDANT, MR JONATHAN SHCULER, NOT WEARING A SEAT BELT. AT THAT TIME I TURNED MY PATROL VEHICLE Around in an attempt to catch the observed VEHICLE which was travelling southbound. upon the DEFENDANT observing my patrol VEHICLE turning around he sped up and made an abrupt left hand turn off of south suncoast BOULEVARD on to west stonebrook drive. the DEFENDANT then made an immediate right hand turn and drove behind a plaza which intersects with south suncoast BOULEVARD and west ivy place. i then pulled behind the VEHICLE and observed the DEFENDANT exiting the drivers side of the VEHICLE and a white female passenger exiting the passenger side of the VEHICLE. at that time, i made contact with the DEFENDANT and the passenger and requested the driver/DEFENDANT's DRIVER'S LICENSE. the DEFENDANT provided me with a food stamp card and advised he did not have a DRIVER'S LICENSE due to his DRIVER'S LICENSE not being valid. i then had teletype conduct an INQUIRY to the DEFENDANT's DRIVER'S LICENSE status. the inquiry confirmed the DEFENDANT's DRIVER'S LICENSE to be suspended INDEFINITELY. a further history check was conducted on the DEFENDANT which revealed that he had been issued a FLORIDA UNIFORM TRAFFIC CITATION on 052810 for driving on a suspended DRIVER'S LICENSE. at that time the DEFENDANT was placed under arrest. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) IN BACK, PLACED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. upon arrival to the CITRUS COUNTY DETENTION FACILITY, the DEFENDANT was issued a FLORIDA UNIFORM TRAFFIC CITATION, number 1953fyax, for not wearing a seat belt and a FLORIDA UNIFORM TRAFFIC CITATION, number 1954fyax, for driving on a suspended DRIVER'S LICENSE (knowingly) and also charged with one count for driving on a suspended DRIVER'S LICENSE. the DEFENDANT's bond was set at $500.00 according to the bond schedule. *NOT-EXEMPT* |
