| Probable cause affidavit: | \tSUBMITTED BY: SLINGERLAND, DANIEL 0443 (AR 14-12495) (14-145651) \tdid then and there unlawfully carry a concealed weapon or electric weapon or device on or about HIS person, to-wit: METAL KNUCKLES, in violation of Florida Statute 790.01(1). \t \tON 102314 AT 2147 HOURS I RESPONDED TO 10495 EAST RABBIT LANE IN FLORAL CITY IN REFERENCE TO ASSISTING WITH A FOLLOW-UP INVESTIGATION. \t \tWHILE ON SCENE CONTACT WAS MADE WITH THE DEFENDANT, MR JUSTIN SKUTA. THE DEFENDANT WAS VERY DISRUPTIVE DURING the COURSE OF THE INVESTIGATION AND MADE SEVERAL ATTEMPTS TO REACH IN TO HIS FRONT POCKET TO RETRIEVE AND UNKNOWN ITEM. THE DEFENDANT WAS TOLD NUMEROUS TIMES NOT TO REACH IN TO HIS POCKETS AT WHICH POINT THE DEFENDANT STATED THAT ''HE DID NOT HAVE ANYTHING ON HIS PERSON.'' HE THEN STATED ''GO AHEAD AND SEARCH ME.'' \t \tAT THAT TIME I ASKED THE DEFENDANT IF HE CONTINUED TO GIVE CONSENT FOR ME TO SEARCH HIM TO which HE STATED YES. I BEGAN SEARCHING the DEFENDANT. AS I FELT HIS RIGHT BACK POCKET, I FELT AN OBJECT that I BELIEVED TO BE A WALLET AS WELL AS A SOLID HEAVY OBJECT. I ASKED THE DEFENDANT IF HE HAD HIS CELLULAR PHONE IN HIS BACK POCKET TO which HE STATED HE DID NOT KNOW. HE ALSO STATED HE HAD HIS WALLET IN THAT POCKET AND STATED ''GO AHEAD AND TAKE IT OUT.'' \t \tUPON REACHING IN THE DEFENDANT'S BACK POCKET I REMOVED TWO ITEMS. THE DEFENDANT'S BLACK WALLET AND A METAL KNUCKLE ALSO KNOWN AS ''BRASS KNUCKLES''. \t \tI ADVISED THE DEFENDANT HE WAS BEING PLACED UNDER ARREST FOR CARRYING A CONCEALED WEAPON. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK. \t \tTHE DEFENDANT DID STATE THAT HE WAS UNAWARE THAT METAL KNUCKLES WERE ILLEGAL AND that IT WAS ILLEGAL TO CARRY THEM ON YOUR PERSON. \t \tTHE DEFENDANT WAS PLACED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. \t \tWHILE AT THE CITRUS COUNTY DETENTION FACILITY A LOCAL CHECK WAS CONDUCTED WHICH REVEALED THE DEFENDANT WAS ARRESTED ON 082114 FOR FELONY DRIVING WHILE LICENSE SUSPENDED HABITUAL OFFENDER. ON 082214 THE DEFENDANT DID POST A BOND IN REFERENCE TO THAT ARREST AND THAT CASE IS CURRENTLY OPEN AND THE DEFENDANT IS OUT OF CITRUS COUNTY DETENTION FACILITY ON BOND. \t \t \t \tTHE DEFENDANTâS BOND WAS SET AT . \t |
