| Comments: | According to official documents McElligott pled guilty in Kittitas County Superior Court on 05/31/2002 to one count of Rape of a Child in the Third Degree. He was sentenced to 42 months in prison. This sentence was suspended and McElligott received a Special Sex Offender Sentencing Alternative. He served a six month jail sentence and participated in community based sex offender treatment. On 04/29/2004 this SSOSA sentence was revoked and McElligott served his original sentence in prison. The revocation was due to McElligott's numerous violations of conditions of supervision which reflected his poor adjustment to supervision. McElligott's conviction was the result of he, and four others sexually assaulting the unknown 14 year old female victim. The sexual assaults took place at a motel where the males had provided the victim with alcohol to the point of severe intoxication, prior to sexually assaulting her. Some of the sexual assaults were videotaped by McElligott. He refused to participate in sex offender treatment while in prison. McElligott is not on supervision and his only requirement is to register as a sex offender. |
