| Probable cause affidavit: | SUBMITTED BY: FWC OFFICER RYAN CRANE (AR13-7112) did drive or was in the actual physical control of a veSSEL while under the influence of alcoholic beverages, model glue or any substance controlled under Chapter 893 or Chapter 877.111 to the extent HIS normal faculties were impaired, in violation of Florida Statute 327.35(1)(A). On 082113, I, OfFICER Ryan Crane of the Florida Fish and Wildlife Conservation Commission (FWC) was on water patrol in the area of Sandy Hook in Citrus County with Investigator Terrence Bing also of FWC. At approximately 1520 hOUrs OFFICER Joe Simpson (FWC) advised me that there were two yellow JET SKIS that had two VISIBLY impaired white males that had been drinking alcohol within 20 yards of their patrol vessel. OFFICER Simpson also stated that the two male individuals were having difficulty putting their life jackets on and appeared to be preparing to depart Sandy Hook.. At approximately 1530 hOUrs, I observed a yellow jet ski (FL5847LA) being pushed in the water by a white male subject (DEFENDANT MR Michael Richard Nadeau DATE OF BIRTH 062573). Nadeau seemed to be having difficulty walking beside the jet ski in approximately two feet of water. Nadeau had a young white female (MS Lindsey D Lay, DATE OF BIRTH 032184) that was visibly intoxicated and had trouble standing in shallow water. At approximately 1630 hOUrs I observed Nadeau and Lay get on the yellow jet ski with some difficulty. I APPROACHED the jet ski and INITIATED the vessel stop in order to conduct a boating safety inspection. Nadeau immediately jumped into the water without being asked to do so. I pulled up to the jet ski and positioned myself downwind of Nadeau and could smell an odor of alcohol EMANATING from his person despite the fact that he was chewing gum. Nadeau appeared sun burnt and had glassy, bloodshot eyes. I asked to see the vessel registration, sound producing device and fire extinguisher. Nadeau produced the fire extinguisher and I asked him if he knew how to check to see if it was operable. Nadeau replied sarcastically that he knEw âhow and wanted to seeâ if I âknew what I was doingâ. I handed Nadeau his registration and he had difficulty placing it back into the container which was next to a beer can in the jet ski. At this point, Nadeau went from being sarcastic to being BELLIGERENT. when I asked him to step into my vessel for safety reasons as he was between the jet ski and my patrol vessel. Nadeau complied. I asked him to sit on the front of my vessel in a comfortable position. Nadeau began to talk to two individuals on the second yellow jet ski and became belligerent with me again in reference to Lay, who was still seated on the jet ski. Nadeau implied in a sarcastic tone that he DID NOT want Lay to float away and get in trouble too. Nadeau continued to show extreme mood changes from cooperative and happy, to belligerent and rude. I advised Nadeau that based on my training and observations that I felt he was impaired and that I needed to administer field sobriety tasks in order to determine that he could safely operate the vessel. Nadeau stated âI plead the Fifthâ. Nadeau again became rude with me in relation to Lay and I assured him that she would be safe and that in order to let him operate the jet ski I had to make sure he was safely able to do so. NADEAU refused to do any sobriety tasks and I placed him under arrest for suspicion of operating a vessel while impaired. At 1642 HOUrs. I placed Nadeau in hand cuffs (double locked) and placed a life jacket on him. I advised Nadeau that he was going to be transported to THE Citrus County Detention Facility where he would be requested to submit a lawful test of his breath. While en route on my vessel Nadeau continued to display mood changes and went from laughing about the arrest to asking me âIf I was religiousâ. Nadeau said that I was a liar and that I would be judged by a higher power. Once we arrived at the Marine Science Center, Nadeau was placed in OFFICER ReeseâS (FWC) patrol vehicle and transported to Citrus County Detention FACILITY. Upon arrival AT THE Citrus County Detention Facility Nadeau was read his implied consent requesting him to submit to an approved test of his breath to determine his breath alcohol content. Nadeau refused to submit to the approved test of his breath. Nadeau stated again that he âpleads the fifthâ and refused to sign his implied consent. While at the CITRUS COUNTY DETENTION FACILITY Nadeau was also found to have two Bud Light PLATINUM bottle caps in his shorts pocket. At this time Nadeau was issued a citation (V368664) for operating a vessel under the influence of alcoholic beverages, any chemical substance set forth in s. 877.111, or any substance controlled under chapter 893, when affected to the extent that the personâs normal faculties are impaired, 327.35(1) (a) with a mandatory court date to be assigned by the jail.
