Commentaries: Comments According to official documents, Barton pled guilty to the crime of 2nd Degree Assault with Deadly Weapon and Sexual Motivation Enhancement on 9-18-2001 and was given a term of 54 months in prison. Barton and the victim were at a party at a home of a mutual friend. Barton asked the victim to go with him so that he could meet a dealer. The victim attempted to have someone else go with her as she was fearful of Barton as he had been brandishing a gun at the party. The victim drove Barton to a park in Mukilteo and Barton began to touch the victim's leg. The victim told Barton to remove his hand from her leg and Barton pulled out his gun which was a 44 caliber revolver and pointed it at the victim's head. He then ordered the victim to remove her coat and get into the back seat of the vehicle. Barton then got into the back seat and told the victim to remove her pants. Barton told the victim to move closer to him and she refused at which time the victim was shot. Police reports state that Barton was playing with the gun and it went off. Barton refused to call the police for help and fled the vehicle. The victim was able to contact medical help. Barton was located that same evening and arrested. Barton told the police that he would have engaged in sexual relations with the victim if the gun had not discharged. While at prison Barton completed sex offender treatment and also drug and alcohol treatment. Barton will be supervised for a period of 48 months by the Department of Corrections, Everett Office. 425-290-3200 Do not associate with known users or sellers of illegal drugs. Do not possess drug paraphernalia. Do not possess or consume controlled substances unless you have a legally issued prescription. Participate and make progress in sexual deviancy treatment. Follow all conditions outlined in your teatment contract. Do not change therapists without advanced permisison of CCO. Participate in offense related counseling programs, to include DOC sponsored offender groups, as directed by CCO. Participate in substance abuse treatment as directed by CCO. Participate in urinalysis, breathalyzer exams, etc as directed by CCO to ensure conditions of community custody. Pay the costs of counseling and medical treatment required by the victim. Residence, living arrangements and employment must be approved by CCO who may direct the RSO to stay out of certain areas (i.e. the town in which the victim lives). Shall have no contact with victim. Shall not possess or consume any alcohol and do not frequent establishments where alcohol is the chief commodity for sale. Stay out of drug areas, as defined in writing by CCO.
