| Comments: | Phillip J. KRAUS - According to official documents on October 3, 2002, Lynnwood Police received a report of a voyeurism occurring at an apartment complex. A resident noticed a male (later identified as KRAUS) standing outside a neighbor's bedroom window holding a video camera. The witness yelled, and the male fled on a bicycle. The man and woman who lived in that apartment told police their bedroom window shades were partially open at the time, and the woman was unclothed at the time the suspect was watching them. They both were unaware they were being watched. After identifying KRAUS as a suspect, police served a search warrant on his home and found over 100 video tapes. A large portion of these video tapes contained images of women, men and children in their homes, appearing to have been taken from outside without their knowledge. The majority of the images recorded were of women in various stages of undress or nudity engaged in sexual activity, but also included images of children. KRAUS also videotaped himself having sex with three unresponsive (known) adult females. The tapes revealed KRAUS positioning their bodies and sexually assaulting them. In each case the women were completely limp and unresponsive to KRAUS' activities, and unable to give consent. When contacted they each told police they did not give their consent to intercourse, nor to be videotaped. For these offense behaviors KRAUS pled guilty to Dealing in Depictions of a Minor Engaged in Sexually Explicit Conduct (sentenced to 60 months), Voyeurism (two counts - sentenced to 12 months), and Indecent Liberties (sentenced to 116 months) in Snohomish County, WA on 3/17/2003. KRAUS participated in and completed the SOTP (Sex Offender Treatment Program) while incarcerated. Due to his sexual criminal history KRAUS has been classified a LEVEL 3 sex offender. |
