| Probable cause affidavit: | SUBMITTED BY: BEETOW, CHARLES 0295 (AR12-00186) DID UNLAWFULLY AND WILLFULLY ENTER OR REMAIN IN A STRUCTURE OR CONVEYANCE, TO WIT: COOTER POND PARK PAVILION, THE PROPERTY OF THE VICTIM, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, THE CITY OF INVERNESS PARKS AND RECREATION, OR THEIR AGENT, IN VIOLATION OF FLORIDA STATE STATUTES 810.09(1)(A). ON 030212, AT APPROXIMATELY 2030 HOURS, WHILE ON PATROL OF THE CITY OF INVERNESS PARKS, I DID OBSERVE A WHITE MALE LAYING ON A PICNIC TABLE UNDER THE PAVILION AT COOTER POND PARK. THIS SUBJECT, WHOM I AM FAMILIAR WITH WAS IDENTIFIED AS MR RICHARD WAMSER. I ASKED RICHARD WHY HE WAS LAYING ON THE PICNIC TABLE AFTER BEING TRESPASSED FROM THE PARK ON 041710. HE DID ADVISE THAT HE DID NOT KNOW AND DID NOT THINK HE WAS TRESPASSED. MR WAMSER WHO WAS HIGHLY INTOXICATED WAS ADVISED THAT HE HAD BEEN TRESPASSED BY THIS AGENCY FROM NOT ONLY COOTER POND PARK BUT LIBERTY PARK ALSO. THE TRESPASS WAS CONFIRMED THROUGH TELETYPE BY OPERATOR NUMBER 0080, WHO ADVISED THAT MR WAMSER HAD IN FACT BEEN TRESPASSED FROM THE PARK ON 041710. SUBJECT WAS THEN PLACED UNDER ARREST FOR TRESPASSING, AND IN DOUBLE LOCKED HANDCUFFS. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS BOOKED, PROCESSED, AND HELD AT $500.00 BOND, PER THE BOND SCHEDULE. |
