Probable cause affidavit: Submitted by Detective Ed Blair – Community Crimes Unit On January 21st, 2013, a Burglary was reported at 101 South Adams Street in Beverly Hills. Contact was made with the victim who reported the theft of an IPod and a safe containing several items. These items include several items of Pearl Jewelry and personal documents. The victim in the case reported receiving a suspicious phone call from her son, Christopher Spinelli. During this call, Spinelli asked when the victim would be home and when she would be gone. The theft occurred within this time frame with no signs of forced entry. Furthermore, the victim advised Spinelli may have the remote code to the garage door, as he had previously assisted with yard work at the residence. Based on the suspicious nature of the phone calls and no signs of forced entry, the victim believed Spinelli perpetrated the Theft. As Spinelli does not live at the residence, nor has he had permission to be at the property, the case was investigated as a Burglary. On February 12th, 2013, this Detective responded to Beverly Hills Gold after receiving information from this Agencies Criminal Intelligence Unit regarding a recent purchase of a pearl necklace matching that of the description listed in this report. Upon arrival, this Detective made contact with Manager, Samantha Bryan. She recalled the transaction and was able to display to this Detective the Florida Pawnbroker Transaction Form and the pearl necklace. The necklace matched that of the victim’s necklace, so photographs were taken. A Hold was placed on the items which had been sold by Zackery Rouse. Ms. Bryan advised Rouse had been accompanied by another young male, matching that of the description of the suspect, Christopher Spinelli Jr. With this information, this Detective responded to the victim’s residence and made contact with the victim. The victim was asked if Christopher had a friend named “Zack”, to which she advised he did have a friend with that name. A photograph of the item was shown to the victim, who advised the necklace was very similar, but she wished to see the pearls in person. This Detective then drove the victim to the Beverly Hills Gold shop. There, the victim was able positively identify the necklace as hers. Furthermore, she was able to provide this Detective with an Affidavit of Property Ownership indicating the necklace was one of the pearls stolen from her residence. The victim purchased the necklace back from the shop at a price of $3. This Detective retrieved the Florida Pawnbroker Transaction Form from the shop. A receipt was given and the item was later turned into the Citrus County Sheriff’s Office for latent comparison. Furthermore, Ms. Bryan signed an Affidavit of Pawn/Second-Hand Dealer Form indicating the sale of the item. The Affidavit named Zackery Allen Porter Rouse as the seller with a Florida Driver’s License Number of R200-981-94-1460. Additionally, the Affidavit indicated Rouse did provide a Thumb Print and proper identification. With this Information, this Detective responded to the address listed on the Pawnbroker Form of 35 Beverly Hills Blvd., where contact was made with his mother’s roommate. She stated he no longer lives at the residence and could be located at 22 North Davis Street. This Detective responded to 22 N. Davis where several young males were sitting in the front porch area. This Detective observed the Burglary suspect, Christopher Spinelli in this group. This Detective asked for “Zack”, at which time he returned in a vehicle. This Detective asked to speak with Rouse, at which time he walked towards this Detective’s vehicle parked in front of the residence. This Detective advised Rouse, he was not under arrest and would not be arrested at the time. This Detective told Rouse, it was not this Detective’s intent to arrest the two without the victim’s request. This Detective then questioned Spinelli regarding the recent Pawn. He stated he did sell the pearls and that they were given to him by Christopher Spinelli. Upon further questioning, he stated the pearls were stolen from Spinelli’s grandmother. Additionally, Rouse advised he had sold the bracelet from the burglary at the Pawn Shop on Roosevelt Blvd. behind Garry’s Automotive. He advised that a Safe was stolen during the theft. For the purposes of indicating specific knowledge by Rouse of the burglary, this Detective did not previously mention a safe was stolen during the Burglary. Rouse advised he would sign a sworn written statement to the facts which we had discussed. After completing the Written Statement, Rouse was sworn to the Statement which was later turned into the Citrus County Sheriff’s Office Records Department. As a follow up to locate further missing items, this Detective responded to Essentials Fine Jewelry and Gifts & Pawn located at 1 Jessie Ct, Beverly Hills. The Manager recalled Rouse and that he attempted to sell a pearl bracelet. She stated she does not deal in pearls and that she did not purchase the bracelet. This Detective later received a phone call from suspect Rouse’s mother, Jessica Rouse, requesting information regarding the reason this Detective was looking for her son. This Detective told her he had pawned pearls stolen during a burglary. Ms. Rouse stated her son had given her a pearl bracelet 2 weeks previous and now believed they may have been stolen. This Detective responded to 35 Beverly Hills Blvd. and made contact with Ms. Rouse. She was able to provide this Detective with the pearls matching that of the pearls and gold clasp sold at Beverly Hills Gold. Ms. Rouse signed a Property receipt releasing the pearl bracelet to this Detective. This Detective then responded to the victim’s residence, where she was shown the pearl bracelet. After speaking with her daughter, the victim advised the pearls match that of pearls located in the safe stolen during this case. At the time of this Affidavit, no other items have been located. The victim was advised of this fact and the criminal procedures regarding the arrest of the suspects in this case. The victim wished to pursue criminal charges in this case. She was advised this Detective would attempt to locate and arrest both subjects in this case for Dealing in Stolen Property. On February 15, 2013 at approximately 1330 hours, this Detective made contact with Spinelli at his residence located at 22 North Davis Street. He was advised he was being placed under arrest and he would be transported to the Citrus County Detention Facility where he would later be released on his own recognizance. He was then transported and this Affidavit was completed.
